Understanding UCMJ Articles 93 and 93a: Cruelty and Maltreatment & Prohibited Activities with Recruits and Trainees

Article 93 – Cruelty and Maltreatment
Covers any service member who is cruel toward, oppresses, or maltreats a person subject to their orders. We explain the elements of the offense, the objective standard used to evaluate conduct, what qualifies as maltreatment (including non-physical abuse), and maximum punishments.
Article 93a – Prohibited Activities with Military Recruit or Trainee by Person in Position of Special Trust
Specifically targets officers, NCOs, and petty officers in training leadership or recruiting positions who engage in prohibited sexual activities or other misconduct with recruits, trainees, or applicants. We cover the two main offenses (abuse of training leadership position and abuse of recruiter position), the “specially protected” junior members, why consent is not a defense, and the strict rules in these environments.
